Agreement to These Terms
Popfeed ("Popfeed," "we," "our," or "us") is a division of Morgan Ventures, Inc., a North Carolina corporation. These Terms of Service (the "Terms") govern your use of the Popfeed website, owner dashboard, feedback widget, embed script, APIs, and related services (together, the "Services"). By joining the waitlist, creating an account, installing the widget, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this document, and your continued use of the Services after changes are published means you accept the updated Terms.
What Popfeed Is
Popfeed is a lightweight website feedback service. Site owners install a single script that renders a feedback launcher, dialog, or in-page form; visitors choose to submit a rating and an optional message; and owners review those submissions in a dashboard and receive alerts by email, webhook, or Slack. Popfeed offers fixed collection modes: experience feedback (a five-face rating), recommendation score (0–10), and satisfaction score (1–10), each with an optional message and an optional reply email.
Popfeed is deliberately not analytics software, session replay, heatmaps, screen recording, chat, a support desk, a survey builder, or an advertising tool. The widget sends no feedback data until a visitor chooses to submit the form.
Waitlist and Early Access
Before general availability, we may operate a waitlist. Joining the waitlist means we will store your email address and contact you about availability, per our Privacy Policy. A waitlist place does not guarantee access, pricing, or launch timing. Early-access features may change or be withdrawn without notice.
Accounts
You must provide accurate account information and keep it current. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised. We may suspend or terminate access if account information is inaccurate, your use creates risk for the Services or others, or you violate these Terms.
Your Responsibilities as a Site Owner
If you install a Popfeed widget, you are responsible for the websites where you install it, the domains you allowlist, the settings you configure, and the notices you provide to your visitors. You agree to use the Services in compliance with the privacy, data-protection, consumer-protection, and accessibility laws that apply to your sites and visitors. Where a law requires notice or a lawful basis to collect feedback or contact details from your visitors, providing it is your responsibility.
Do not use the Services to collect sensitive information, such as government identification numbers, payment card or bank details, passwords, or health information, through the feedback form. The form is designed for opinions about your website, not for regulated data.
Visitor Submissions
Feedback messages, ratings, optional contact details, and page context submitted through your widgets ("Submissions") belong to your account. You represent that you have the rights needed to collect and use Submissions through the Services. You grant us a limited license to host, store, process, transmit, and display Submissions solely to provide, secure, support, and improve the Services. We claim no ownership of Submissions and do not publish them.
We may remove or restrict access to content that violates these Terms, creates security or legal risk, or may harm the Services or others.
Acceptable Use
You may not use the Services to:
- Submit or collect unlawful, harmful, deceptive, defamatory, obscene, or infringing material;
- Send spam, malware, or malicious code, or generate fake or automated feedback;
- Probe, overload, disrupt, or interfere with the Services, or circumvent rate limits, signed submission tokens, domain validation, or other abuse controls;
- Install the widget on websites you do not own or lack authorization to modify;
- Build surveillance, hidden tracking, or profiling on top of the Services;
- Misrepresent who is collecting feedback or impersonate another person or organization.
Notifications and Delivery
You may configure notification email addresses, webhook URLs, and Slack incoming-webhook URLs. Configure only destinations you control or are authorized to use. Feedback is stored first; delivery runs afterward, and a delivery failure never deletes a stored submission. Email, webhook, and Slack delivery are provided on a best-effort basis and may fail or be delayed for reasons outside our control, including destination outages, spam filtering, and invalid configuration. Webhook payloads are signed so you can verify they came from us; you are responsible for how your destinations store and protect delivered content.
Branding
The widget may display a "Powered by Popfeed" attribution. Where your plan allows disabling attribution, the dashboard setting controls it. "Popfeed," the Popfeed logo, and related marks are trademarks of Morgan Ventures, Inc.; do not use them without written permission.
Plans and Fees
The Services may include free and paid plans. If we introduce paid plans, pricing and included usage will be presented before you are charged, and billing, renewal, cancellation, and refund terms will be described at checkout. We may establish reasonable limits on use of the Services (including request volume, message size, retained content, and abuse controls) and may adjust limits to protect the Services.
Availability and Changes
We may modify, suspend, or discontinue all or part of the Services at any time. The Services may be unavailable due to maintenance, updates, outages, or events outside our control. We will make reasonable efforts to keep the public embed script stable and backward-compatible for installed snippets.
Intellectual Property; Suggestions
We and our licensors own the Services and all related intellectual-property rights. These Terms grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes; they transfer no ownership. If you send us suggestions or ideas about Popfeed itself, we may use them without restriction or compensation. This does not apply to your visitors' Submissions.
Termination
You may stop using the Services at any time; removing the snippet from your sites stops collection. We may suspend or terminate the Services or your account for violation of these Terms, risk to the Services, or extended non-payment on a paid plan. Upon termination we will make reasonable efforts to allow export of your Submissions for a limited period unless legal or security reasons prevent it.
Disclaimer of Warranties
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we and our suppliers disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any submission, notification, webhook, or report will always be delivered or retained.
Limitation of Liability
To the fullest extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost goodwill, lost data, or business interruption, arising from or related to the Services. Our total liability for all claims relating to the Services will not exceed the amounts you paid us for the Services in the twelve (12) months before the claim, or one hundred U.S. dollars ($100) if you have paid nothing.
Indemnity
You will defend, indemnify, and hold harmless Popfeed, Morgan Ventures, Inc., and their officers, employees, and agents from claims, damages, expenses, and liabilities arising from your websites, your Submissions, your use of the Services, your violation of these Terms, or your violation of any rights of a third party, including your visitors' privacy rights.
Governing Law and General Terms
These Terms are governed by the laws of the State of North Carolina, excluding conflict-of-law rules. Exclusive jurisdiction and venue for disputes lie in the state and federal courts located in Raleigh, North Carolina, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect; our failure to enforce a provision is not a waiver. Sections that by their nature should survive termination (including Visitor Submissions, Acceptable Use, Disclaimers, Limitation of Liability, Indemnity, and this section) survive.
